Terms and Conditions
Moma.it and its related services are made available to you in accordance with the following terms and conditions. Please read them carefully before placing an order. The website is operated by FRAGO S.r.l., with registered office at Via Assisi 15, 62010 Montecosaro (MC), Italy. Contact: ecommerce@moma.it, +39 0733 865103. VAT number: IT00168010437. Each order is governed by the terms in force at the time the order is placed. Your statutory rights are not affected.
Acceptance of your order
Once you have placed your order, you will receive an email acknowledging receipt of your details. This is not an order confirmation. The contract between you and Moma is formed when you receive the email containing tracking information. We reserve the right not to accept your order if the item is out of stock, fails our quality control, or if we are unable to obtain payment authorisation. All orders are subject to availability and price confirmation.
Prices and availability
We make every effort to ensure that all details, descriptions and prices shown on the website are accurate, but errors may occur. If we discover an error in the price of a product you have ordered, we will inform you as soon as possible and you may choose to reconfirm your order at the correct price or cancel it. If we are unable to contact you, the order will be treated as cancelled. If you cancel and have already paid, you will receive a full refund. If the items ordered are out of stock, delayed, or contain errors in their details or description, we will try to contact you at the email address you provided. If we are unable to contact you regarding out-of-stock items, we will cancel the order within 48 hours and you will receive a full refund.
Shipping
We aim to dispatch all orders within 7 working days, subject to production times, payment verification and address verification. Shipments are insured in transit from our warehouse until signed for on delivery, at which point responsibility for the goods passes to you. Tracking information will be sent to you by email. If you do not receive it, please contact ecommerce@moma.it. To ensure the fastest possible delivery, please provide a telephone number. Shipped orders that cannot be delivered will be returned to us, and the cost of reshipping will be borne by the customer. An additional charge will apply if you are not available during the specified delivery window or if the courier is required to wait. We are not responsible for delays caused by customs clearance or payment processing. During sales and peak periods, deliveries may take longer. We periodically offer free shipping promotions. To receive promotional codes and other offers valid on our website by email, subscribe to our newsletter.
Duties and taxes
You can shop online in any currency. Orders to non-EU countries are shipped on a DAP basis; for EU countries, please see our Shipping Policy. Under DAP, any duties and taxes due in the destination country are the customer's responsibility. We cannot guarantee that customs charges will be waived for a refused shipment. In that case, the relevant amount will be deducted from your refund.
Withdrawal
You have the right to withdraw from your purchase within 14 days of delivery. The procedure, costs and refund timeframes are set out in our Refund Policy, which forms part of these terms.
Exchanges
If you wish to exchange an item, please email ecommerce@moma.it and we will advise you on how to proceed. See also our Refund Policy.
Payment
You can pay using the methods shown at checkout. If you choose PayPal, you will be redirected to the PayPal website to log in and review the amount before clicking "Pay Now". Once the transaction is complete, you will be returned to Moma. We accept Visa, Mastercard, American Express, Maestro and Diners Club. All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer refuses to authorise payment, we will not be liable for any delay or non-delivery, and we reserve the right to cancel the order. All transactions on this website are processed through PayPal and Shopify Payments, a secure payment gateway that encrypts your card details in a protected environment. Liability and indemnity
FRAGO S.r.l. is liable to consumers within the limits provided by law. We may immediately suspend your use of the website if we believe you have breached these terms and conditions.
Copyright
This website is owned by FRAGO S.r.l., which operates it under the Moma brand. All content on the website, including images, designs, logos, photographs and text, is protected by copyright owned by FRAGO S.r.l. All rights reserved worldwide. The website and its content may be used for personal, non-commercial purposes only. Any reproduction, in whole or in part, is prohibited without prior written permission.
General
We may amend these terms and conditions at any time, but each order remains governed by the terms in force at the time it was placed. Please read them and check back regularly.
Legal guarantee. All products are covered by the 2-year legal guarantee of conformity from the date of delivery (Articles 128 et seq. of the Italian Consumer Code).
Complaints and dispute resolution. Complaints should be sent to ecommerce@moma.it. FRAGO S.r.l. does not participate in any ADR body. You may refer to the ADR bodies provided for by the Italian Consumer Code.
Governing law and jurisdiction. These terms are governed by Italian law, without prejudice to any more favourable provisions of the law of your country of residence. For disputes with consumers, the competent court is that of the consumer's place of residence or domicile. For non-consumer buyers, the competent court is the Court of Macerata.
